Adult Film Actresses Campaign Against Proposition 60 on Library Walk

Several adult film artists, including Tasha Reign, visited the campus on Monday afternoon to distribute brochures and advocate against Proposition 60 to students, staff and faculty. Proposition 60, which will appear on the ballot in November, seeks to require the use of condoms and other protective barriers in pornographic films.

The official and shorter summary of the initiative states that the proposal requires actors in adult films to use condoms when filming sex; producers must pay for vaccinations, tests and medical examinations of performers; and producers to display the condom requirement at filming locations. Additionally, the expected fiscal impact is an annual loss of several million dollars in state and local tax revenue and an increase in state spending of over $ 1 million on regulations.

Adult film artist and YouTuber Mia Li told UCSD’s Guardian that she was against Proposition 60 because application of the measure could expose her and other artists to lawsuits, even though there is no evidence that the law has been broken.

“Any California resident, performer, or state agency can enforce this proposal, and this performance is a form of prosecution against the performers. […] so that people can actually make money by suing performers, ”Li said.[…] it can be a setting of people kissing, where genital penetration is not seen, and it is grounds for legal action, when they could in fact use the protective barrier.

However, the Yes on Prop 60 campaign, led by AIDS Health Foundation President Michael Weinstein, says the initiative specifically prevents adult film performers from being prosecuted in subsection five of the. section four, which reads: “Liability under this Act does not apply to performers of adult films, bona fide employees, persons providing independent contractual services or volunteer production of ‘a producer of adult films who act within the framework of the general services provided and in accordance with the instructions of the producer of adult films… ”Supporters of Prop 60 further state that the initiative will be of benefit to performers of adult films because it will prevent them from contracting diseases at work and protect their health.

Hernando Chaves, teacher and therapist who accompanied the actresses, clarified that because many performers are also producers, they can always be sued as producers.

“Many performers trade content with other performers, create content for their websites to sell, use camera shows and bill viewers, earn income from affiliate programs, and many other ways they have a financial interest and engage in production / producer roles. ”Chaves told The Guardian. “Most performers produce content and are therefore producers for themselves. Unfortunately, the language of the proposal assumes that there is a clear separation between producer and performer, when in fact they overlap for the overwhelming number of performers.

Li also noted that the use of condoms is not an issue in the pornographic film industry to begin with, as the industry is largely self-regulating and has worked with the California Safety and Health Division. at work.

“We have protocols, tests and the possibility of being autonomous about our sexual health; we are not anti-condoms at all, “Li said.” We are pro-option, which this proposal will take away from us because we are the people who have the most intimate knowledge of how our bodies work, what is good for us and what is safe for us. We are currently working with Cal / OSHA to have our regulations that we ourselves have created beyond paper, and that completely replaces the work that we have done. ”

According to Li, she and other adult film artists have visited several other universities to speak with students, as they believe students will be more receptive to hearing their information.

“We think this generation is more open-minded, more sexist and willing to hear because we know there is so much stigma attached to the industry and sex work and adult cinema, and I think that this generation who is here in a learning process is more willing to educate themselves and hear the voices of people in the industry, ”Li said.
